We are the Ka Puta Ka Ora Emerge Aotearoa group of charitable enterprises, which is comprised of several organisations, each of which delivers its own unique brand of services, including;

  • Emerga Aotearoa Trust, registered under the Charities Act 2005 with registration number CC44961.
  • Emerge Aotearoa Limited, registered under the Charities Act 2005 with registration number CC45040.
  • Emerge Aotearoa Housing Trust registered, under the Charities Act 2005 with registration number CC33639.
  • Mind and Body Consultants Limited, registered under the Charities Act 2005 with registration number CC52855, and
  • Ignite Aotearoa Limited, registered under the Charities Act 2005 with registration number CC52857.
  1. Application of these terms

These Terms govern your use of the websites associated with each of the group organisations. You can print off these Terms, or store them on your computer, for future reference. Please read them carefully. If you do not wish to accept these Terms, then please do not use the websites.

  1. General rules on your use of the websites

The group websites are designed to provide information and encourage understanding and support for Ka Puta Ka Ora Emerge Aotearoa’s wide range of health and social services. Our mission is all about strengthening whānau so communities can thrive.

However, by using these websites you accept that you must not:

  • reproduce in any way any information and/or material appearing on the websites which infringes the Intellectual Property of anyone else;
  • copy, in whole or in part, any of the information on the websites except as permitted by these Terms;
  • permit or create unauthorised framing of, or deep linking to, the websites from another website under your management or control;
  • copy, adapt, modify, reverse engineer, disassemble or decompile any of the software underlying the websites; or
  • create or maintain any unauthorised connection to any of the websites.

The content provided on the websites is protected by Intellectual Property owned by us or others.

Except as expressly permitted by these Terms, you may not copy, download or distribute any content from any of the websites, other than your own content.

  1. Liability

We exclude to the fullest extent permitted by law, all liability for any loss (including loss of profit, business, contracts or goodwill) incurred by you as a result of your use of or inability to use any of the websites, or your reliance on information within the websites.

We shall not have any liability to you for any delay in performance of the services described on the websites or any other matters to the extent that such events or matters are due to any events outside our reasonable control.

The websites are accessed via the World Wide Web, which is independent of us. Your use of the World Wide Web is solely at your own risk and subject to all applicable national and international laws and regulations. We do not represent that the websites are appropriate or available for use in any jurisdiction other than New Zealand. We shall have no responsibility for any information or service obtained by you on the World Wide Web.

  1. Availability of the websites

We make reasonable efforts to ensure that the information and material provided on the websites is accurate and up-to-date, however errors or conflicts in the data may occur, and may not be correctable.

We reserve the right to interrupt the websites on a regularly scheduled basis or otherwise, with or without giving prior notice, in order to perform maintenance. However, we will use reasonable efforts to schedule maintenance during low-usage times of day.

We will not be liable for any inability to access any of the websites, resulting from any causes beyond our reasonable control, such as the quality of your Internet connection or the operation of systems on the websites.

You are responsible for obtaining Internet access to the websites from where you are. We cannot be held responsible for your failure to access the websites from any location or browser. Any access fees incurred in reaching the websites (e.g. dial up charges) and any equipment necessary to facilitate access are your responsibility.

These Terms are governed by New Zealand law, and you and we agree to submit to the non-exclusive jurisdiction of the New Zealand Courts.
